Employers must already take reasonable steps to prevent sexual harassment and handle concerns carefully, with enhanced whistleblowing protections for those who speak up. From 1 October 2026, the duty increases to taking all reasonable steps — a significantly higher standard — and employers will also be liable for harassment by third parties, across all protected characteristics.
